Article 45 - Transfers on the basis of an adequacy decision

Article 45 of the EU General Data Protection Regulation sets out the conditions for transferring personal data to third countries when the European Commission has issued an adequacy decision, confirming that the destination provides a level of data protection essentially equivalent to that guaranteed in the EU. It allows such transfers without additional safeguards, provided the decision remains in force and the recipient complies with the stipulated requirements.
