Article 46 - Transfers subject to appropriate safeguards

Article 46 governs transfers of personal data to third countries or international organisations where the EU has not recognised an adequacy decision. It permits such transfers only if the controller or processor provides appropriate safeguards, for example standard contractual clauses, binding corporate rules, approved codes of conduct or certification mechanisms, and requires cooperation with supervisory authorities.
