Art 5(3) - Cookie consent requirement

Art 5(3) of Directive 2002/58/EC obliges Member States to ensure that any storage or access to information on a user's terminal equipment, such as cookies, occurs only after the user has given informed consent. The provision forms the legal basis for cookie-consent requirements in electronic communications.
